Fegud Terms of Service

1Agreement and scope

These Terms of Service are an agreement between Fegud, the Canadian wellness business based in Toronto, Ontario that operates the services described here, and the person or organization using a Fegud service.

In these terms, Company means an organization with a Fegud for Teams subscription. Administrator means a person the Company authorizes to manage that subscription.

By accessing or using the website, app, shop, free bingo challenge, HR Admin Dashboard, or Fegud for Teams, you agree to these terms. If you use Fegud for an organization, you confirm that you have authority to accept terms for that organization.

If you do not agree, do not create an account, place an order, or continue using the service.

2Services and eligibility

Fegud provides general-wellness products and services, including:

• free printable bingo cards and the Fegud app for individual use
• Fegud for Teams, including the employee app and HR Admin Dashboard
• physical products sold through the Fegud Shop
• the public website, forms, support, and related content

You must be at least 18 years old to create an account, join a program, or buy from the shop. You must also have legal capacity to agree to these terms where you live.

Features, supported devices, languages, and regional availability may change. Physical-product availability is confirmed in the shop and at checkout. A material change to an active paid Teams service is handled under Section 14 and any signed company terms.

3Accounts and access

Provide accurate information, keep your sign-in method secure, and tell us promptly if you suspect unauthorized access. You may not sell, transfer, share, or impersonate another person’s account.

Employees may join a Company program only through an authorized company invitation link or join code. Company administrators are responsible for managing their authorized administrators and removing access that is no longer appropriate.

A Company is responsible for activity performed by its authorized administrators. Each member remains responsible for their own activity and content.

Contact [email protected] if an account may be compromised. Privacy requests, including access, correction, export, or deletion, should be sent to [email protected].

4Shop orders

Shop prices and checkout charges are shown in US dollars unless the checkout says otherwise. Your bank or card provider may convert the charge and may add its own fee.

Check the product, quantity, address, shipping option, taxes, and total before paying. An order is accepted when Fegud confirms it. We may decline or cancel an order for a pricing or listing error, suspected fraud, unavailable stock, an unsupported destination, or another reasonable operational or legal reason. If Fegud cancels an accepted, paid order, we will issue a full refund to the original payment method. The payment provider controls when the refund appears.

We try to present product descriptions and images accurately. Screen settings and normal production differences can affect how a color or item appears.

5Fegud for Teams trial, payment, and cancellation

THE TRIAL

The standard Fegud for Teams trial lasts seven days. It does not require a credit card and does not create an automatic charge. A paid subscription begins only after an authorized Company administrator selects a plan and payment schedule and completes the payment step.

THE PAID TERM

Standard paid plans carry a 12-month commitment. A Company may pay once for the annual term or use a schedule of twelve monthly payments. Monthly billing spreads the same commitment across twelve payments. It is not a month-to-month plan.

Current plan prices and included features appear on the Pricing page and at checkout. Charges are in US dollars unless signed company terms say otherwise. Taxes may apply. A bank or card provider controls any currency conversion and its own fees.

CANCELLATION AND RENEWAL

An authorized administrator may request cancellation in the Billing section of the HR Admin Dashboard or by emailing [email protected]. The Stripe billing portal can update payment details, billing information, and invoices, but it does not cancel a Fegud for Teams subscription.

Unless checkout or signed company terms say otherwise, a paid plan renews automatically for another 12-month term on its renewal date. The existing annual or monthly payment schedule carries forward. Before renewal, Fegud will send the Administrator the renewal date and price using the contact details on the account.

An authorized Administrator must request cancellation before the renewal date shown in the account or renewal notice. A confirmed cancellation stops the next renewal. It does not normally shorten the active 12-month term, refund an annual payment, or stop the remaining monthly payments. Exceptions apply where required by law, where Fegud corrects a billing error, or where signed company terms say otherwise.

If a payment fails or remains overdue, Fegud may restrict paid features after reasonable notice and an opportunity to update payment details. Suspension does not erase amounts already due under the active term.

6Acceptable use

Use Fegud lawfully and in a way that respects other people, organizations, and the service. You must not:

• harass, threaten, exploit, discriminate against, or impersonate another person
• post unlawful, defamatory, sexually explicit, or rights-infringing material
• gain or attempt to gain unauthorized access to an account, system, or data
• send malware, spam, harmful code, or unsolicited commercial messages
• scrape, copy, probe, overload, reverse engineer, or bypass a security or privacy control
• resell, sublicense, or provide unauthorized access to a Fegud service
• share an invitation, join code, or access route with someone who is not entitled to use it
• use Fegud in breach of law, sanctions, export controls, or another person’s rights

EMPLOYER BOUNDARY

A Company or administrator must not use Fegud to secretly monitor employees, infer individual wellness activity, discipline someone for participation, or defeat an aggregate-reporting safeguard. Participation must remain voluntary. A Company is responsible for meeting its employment, privacy, consent, and human-rights obligations.

7Community content and moderation

You keep ownership of content you submit. You give Fegud a limited, non-exclusive permission to host, store, display, transmit, and process that content only as needed to operate, secure, and support the service. This permission ends when the content is deleted, except for backups, legal records, or other retention described in the Privacy Policy.

Fegud may review a report, remove content, limit posting, block access, or suspend an account when we reasonably believe content or conduct breaks these terms, harms someone, creates a security risk, or violates law.

Community reports are handled by Fegud, not by an employer. An HR administrator does not receive a member’s report or private activity through the moderation process.

For a copyright or trademark concern, email [email protected] with the work or right involved, the location of the disputed material, your contact details, and why you believe the use is unauthorized.

8Fegud content and intellectual property

Fegud and its licensors own the service, software, visual design, brand, activities, reports, website copy, and other Fegud-provided content. These terms give you a limited, revocable, non-transferable right to use the service for its intended purpose while you have access.

You may not copy, modify, distribute, sell, license, remove branding from, or use a Fegud service or its content to build a competing product unless Fegud gives written permission or the specific page clearly permits that use.

A printable or download may include its own use instructions. Those instructions control the permitted use of that item.

9Privacy and the employer boundary

The Privacy Policy explains what Fegud collects, why it is used, which service providers receive information, retention schedules, international processing, and how to make a privacy request.

For Fegud for Teams, employers receive aggregate program reporting. They do not receive a member’s individual activity, private notes, answers, or personal wellness profile through the HR Admin Dashboard.

A Company is responsible for having an appropriate legal basis and giving required notices before providing employee information to Fegud. Where Fegud processes that information for the Company, signed data-processing terms may also apply.

Fegud does not sell personal information for money. The Privacy Policy explains the limited information that analytics, advertising, commerce, payment, and other providers may receive. Read the Privacy Promise for the short version of the employer boundary.

10Wellness disclaimer

Fegud provides general wellness and self-care activities. It is not a medical, mental-health, diagnostic, emergency, insurance, or healthcare service. Content and check-ins are not medical advice and do not replace care from a qualified professional.

Use your judgment. Skip an activity that is not suitable for you. Stop if you feel pain, unwell, unsafe, or distressed. Seek appropriate professional or emergency help when needed.

No card, score, streak, badge, team result, or activity should be treated as a health assessment, employment assessment, or promise of a particular outcome.

11Third parties and service availability

Fegud uses third-party services for functions such as payments, commerce, hosting, communications, analytics, app distribution, and infrastructure. Those providers may apply their own terms when you use their service directly.

We work to keep Fegud available and accurate, but no online service is uninterrupted or error-free. Maintenance, security work, provider outages, internet conditions, device limits, or events beyond reasonable control may affect access.

Links to a third-party site are provided for convenience. Fegud does not control that site’s content, availability, security, or privacy practices.

12Suspension, cancellation, and ending access

You may stop using a free service at any time. Account deletion and privacy requests follow the controls and process described in the Privacy Policy. A Teams cancellation follows Section 5 and the Teams subscription sections of the Return & Refund Policy.

Fegud may restrict or suspend access when reasonably necessary to address a material breach, security threat, harm to another person, unlawful use, non-payment, or legal obligation. Where practical and safe, we will explain the reason and tell you what needs to be fixed.

Ending access does not automatically delete every record. Personal information, exports, deactivated accounts, cancelled company tenants, payment records, suppression records, disputes, and backups follow the retention rules and safeguards in the Privacy Policy. Do not rely on cancellation alone as a deletion request.

Terms that naturally continue after access ends, including payment obligations, ownership, privacy, liability limits, dispute terms, and rights that arose earlier, remain in effect.

13Liability and legal rights

Nothing in these terms excludes, restricts, or replaces a right or remedy that cannot lawfully be waived. This includes liability that law does not allow Fegud to exclude.

To the extent law permits, Fegud is not responsible for indirect, special, incidental, punitive, or consequential loss, or for loss caused by a user’s conduct, an unsupported device, internet failure, or a third-party service outside Fegud’s reasonable control.

For a paid service or shop order, where law allows a financial limit, Fegud’s total liability for a claim is limited to the amount paid for the service or order that gave rise to the claim during the 12 months before the event. For a free service, liability is limited to direct, reasonably foreseeable loss to the extent law permits.

These exclusions and limits do not apply to Fegud’s fraud, wilful misconduct, gross negligence, breach of confidentiality or data-security duties, infringement of another person’s intellectual property, or any liability that applicable law does not allow Fegud to limit.

14Governing law, changes, and contact

LAW AND DISPUTES

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Mandatory consumer, employment, privacy, and other rights in your jurisdiction still apply.

Please email [email protected] before starting a formal claim so we can try to resolve the issue. This request does not stop you from seeking urgent relief or meeting a legal deadline. Where law permits, disputes that are not resolved informally may be brought in the courts of Ontario.

GENERAL TERMS

These terms, the policies linked here, and any signed company agreement form the agreement that applies to the relevant service. If one part is unenforceable, the rest continues. A delay in enforcing a right is not a waiver.

You may not transfer an account or these terms without written consent. Fegud may transfer these terms as part of a reorganization, financing, sale, or transfer of the relevant business, subject to applicable law and privacy obligations.

Fegud is not responsible for delay caused by an event beyond reasonable control, but this does not excuse an obligation that law says must still be performed.

CHANGES TO THESE TERMS

We may update these terms as services, law, or operations change. The page shows the latest update date. For a material change affecting an active paid Teams service, we will give reasonable advance notice through the administrator’s account or contact details.

A page update will not increase fees already committed for an active term or materially reduce the purchased service during that term. A change like that requires the Company’s agreement, applies at renewal, or follows a right provided in signed company terms or applicable law. If law requires consent, we will ask for it.
