Terms of Service

Please read these Terms carefully. By accessing or using any Fegud service (including the website, the free bingo challenge, the online shop, and the Fegud for Teams platform), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

1 The Parties

These Terms form a legally binding agreement between Fegud (operating as Fegud and Fegud for Teams), incorporated in Canada and headquartered in Toronto, Ontario (“Fegud,” “we,” “us”), and you, the person accessing our services.

The following definitions apply throughout these Terms:

  • “Company”: the organisation that has entered a subscription agreement with Fegud for Teams
  • “HR Administrator” or “Admin”: the Company representative who manages the Fegud for Teams subscription
  • “Employee” or “User”: an individual who participates via the Fegud mobile app
  • “Customer”: an individual who purchases from the Fegud online shop
  • “Participant”: an individual who signs up for the free monthly self-care bingo challenge
  • “Platform”: all Fegud products including the mobile app, HR Admin Dashboard, website, and online shop

2 Description of the Service

Fegud operates two core services:

2.1 Fegud (B2C)
  • The free monthly self-care bingo challenge: sign up at fegud.com to receive a printable PDF bingo card each month and follow @i.fegud on Instagram and TikTok for daily challenges
  • The Fegud online shop: merchandise and wellness products available at fegud.com/shop, powered by SureCart
  • The Fegud website: the public marketing and information website at fegud.com
2.2 Fegud for Teams (B2B)
  • The Fegud employee mobile app (iOS and Android): where employees receive personalised monthly bingo cards, complete daily wellness challenges, and connect with teammates
  • The Fegud HR Admin Dashboard (app.fegud.com): where HR Administrators manage accounts, invite employees, view analytics, download reports, and manage billing

Not medical advice. Fegud is a software-as-a-service (SaaS) wellness product. We do not provide medical advice, clinical wellness programmes, or healthcare services of any kind. See Section 10 for the full wellness disclaimer.

3 Shop & Website Terms

This section applies to use of the Fegud website (fegud.com) and online shop. By visiting our site and purchasing from us, you agree to these Terms in full.

3.1 Eligibility

You must be at least the age of majority in your province or state of residence to make a purchase from the Fegud shop. By placing an order, you confirm that you meet this requirement. Our site is not directed at individuals under the age of 18.

3.2 Products and Pricing

We have made every reasonable effort to display product colours, images, and descriptions accurately. We cannot guarantee that your device’s display will accurately reproduce product colours. Product descriptions and pricing are subject to change at any time without notice, at our sole discretion.

We reserve the right to:

  • Refuse any order placed with us at any time, for any reason
  • Limit quantities of any product offered for sale
  • Discontinue any product at any time
  • Restrict sales to any person, geographic region, or jurisdiction

In the event an order is cancelled or modified, we will contact you using the email or phone number provided at checkout.

3.3 Order Accuracy and Billing Information

You agree to provide current, complete, and accurate purchase and account information for all orders. You agree to promptly update your account details, including email address and payment information, so that we can complete your transactions and contact you as needed.

We may limit or cancel orders that, in our sole judgement, appear to be placed by resellers or distributors. This includes orders placed under the same customer account, the same credit card, or orders using the same billing or shipping address in unusual volume.

3.4 Returns and Shipping

Online store purchases are subject to our Return & Refund Policy and Shipping Policy. Please review these policies before placing an order.

3.5 Third-Party Tools

Our store is hosted on SureCart. We may also provide access to third-party tools and services we do not control. Access to such tools is provided “as is” without any warranties or endorsement. Use of third-party tools is at your own discretion and risk.

You must not use our services for any illegal or unauthorised purpose. You must not transmit malicious code, worms, or viruses. A breach of these Terms may result in immediate termination of your access to Fegud services.

4 Accounts & Access

4.1 Company Accounts (Fegud for Teams)

Companies using Fegud for Teams must:

  • Provide accurate and complete registration information
  • Maintain the security of HR Admin login credentials
  • Take responsibility for all activity under their account
  • Ensure employees use the platform in compliance with these Terms
  • Notify Fegud immediately of any unauthorised access at [email protected]
4.2 Employee Accounts

Employees access the platform using a Company Code provided by their employer. By creating an account, employees confirm they are at least 16 years old, that the Company Code was legitimately provided, and that the information they provide is accurate.

4.3 Account Security

You are responsible for keeping your login credentials confidential. Fegud will never ask for your password by email, phone, or any other channel. If you suspect your account has been compromised, contact us immediately at [email protected].

5 Subscriptions & Billing

This section applies to Fegud for Teams subscriptions. Shop purchases are covered in Section 3.

5.1 Subscription Plans

Every Fegud for Teams subscription is a 12-month commitment. Companies may pay in one of two ways: as a single annual payment upfront, or spread across twelve monthly payments. Both options are billed securely through Stripe and both represent the same 12-month commitment. Prices are confirmed at checkout in the currency applicable to your company’s country of registration.

Paying annually is the lowest-cost option. Monthly billing works out to approximately 20% more on an annual basis, in exchange for spreading the cost across the year. Both are a 12-month commitment.

5.2 Annual Payment

Annual subscriptions are billed once per year, in advance, at the start of each subscription year. The full annual amount is due at the time of subscription or renewal, providing access to the platform for the full 12-month period. Annual payment is the lowest-cost option.

5.3 Monthly Payment

Companies that prefer to spread the cost may choose monthly billing. Monthly billing is a payment schedule, not a separate subscription tier or a short-term plan. The Fegud subscription remains a 12-month commitment regardless of how it is paid for.

When a Company chooses monthly billing, Stripe charges the monthly amount on the same day each month for twelve consecutive months. Monthly billing works out to approximately 20% more than annual payment over the course of the year. Monthly billing is available across all plan tiers (Starter, Growth, and Business; Enterprise pricing is custom).

Important about monthly billing: Choosing monthly billing does not shorten or change the 12-month commitment. The Company agrees to all twelve monthly payments. If the subscription is cancelled partway through the term, the remaining monthly payments continue through the end of the 12-month period, as described in Section 5.9.

5.4 Currency

Subscriptions are charged in the currency of your company’s country of registration: Canadian Dollars (CAD) for Canada, US Dollars (USD) for the United States, and British Pounds (GBP) for the United Kingdom. Prices shown on fegud.com are in USD unless otherwise stated. The correct currency is applied at checkout based on your billing address.

5.5 Free Trial

All Fegud for Teams plans include a 7-day free trial with no credit card required. The trial provides full platform access for the Company, including the employee mobile app and HR Admin Dashboard, for the trial period.

Trial mechanics:

  • No payment information is collected at the start of the trial
  • Fegud sends an email reminder to the HR Administrator 3 days before the trial ends
  • To continue using Fegud, the HR Administrator must enter payment information following the trial reminder
  • If payment information is not entered, the trial expires automatically at the end of day 7 and the account is deactivated. No charge is made
  • If payment information is entered, the paid subscription begins on day 8, when the first charge is made (the full annual amount, or the first monthly payment)

If a Company needs more time to evaluate Fegud before the trial ends, it may contact [email protected] to request an extension, which Fegud can often accommodate at its discretion. Once a paid subscription begins, the 12-month commitment applies as described in Section 5.6.

5.6 Commitment and Refunds

Fegud for Teams is offered with a 7-day free trial so that a Company can evaluate the platform before any payment is made. Once the trial ends and a paid subscription begins, the subscription is a 12-month commitment and is non-refundable.

  • Annual subscribers: The annual fee covers the full 12-month term and is not refunded if the subscription is cancelled partway through the term.
  • Monthly subscribers: The monthly payments cover the full 12-month term. Cancelling partway through the term does not stop the remaining monthly payments, which continue through the end of the 12 months.

Because the 7-day free trial gives the Company a no-cost opportunity to evaluate Fegud before committing, Fegud does not offer refunds once a paid subscription has begun. A Company that needs more time to decide may request a trial extension before the trial ends, as described in Section 5.5. Cancellation mechanics are detailed in Section 5.9 and in the Return & Refund Policy.

No charge is made during the trial. If a Company decides not to continue, it simply does not enter payment information, and the trial expires with nothing owed. The 12-month commitment begins only when a paid subscription starts at first charge.

5.7 Upgrades and Downgrades

Upgrades take effect immediately. The Company is charged the prorated difference between the current and new plan for the remaining portion of the current 12-month term. For annual subscribers, this is a one-time prorated charge; for monthly subscribers, the remaining monthly payments are adjusted to the new plan’s rate. The renewal date and the end of the 12-month term do not change.

Downgrades take effect at the start of the next term (next renewal). No partial refund or credit is issued for the current term, and any remaining payments on the current term continue at the current plan’s rate.

5.8 Renewals

Annual subscriptions renew automatically at the end of each 12-month period unless cancelled. Fegud will send a renewal reminder to the HR Admin email address at least 30 days before the renewal date.

5.9 Cancellation

You may cancel your subscription at any time by contacting [email protected] or through the HR Admin Dashboard. Cancellation means the subscription will not renew for a further term. It does not end the current 12-month commitment early.

Annual subscribers: Your team retains access through the end of the current 12-month term. The annual fee already paid is not refunded for the remainder of the term.

Monthly subscribers: Your team retains access through the end of the current 12-month term, and the remaining monthly payments continue through that term. Cancelling stops the subscription from renewing for a further year but does not stop the remaining payments of the current commitment.

No refunds are issued once a paid subscription has begun, as described in Section 5.6. Full cancellation mechanics are detailed in the Return & Refund Policy.

5.10 Non-Payment

If a payment fails, whether an annual renewal charge or a monthly payment, Fegud will notify the HR Admin and provide a 14-day grace period to update payment details. If payment is not received within 14 days, access to the platform may be suspended. Suspension for non-payment does not release the Company from the remaining payments owed under the 12-month commitment.

5.11 Taxes

All prices are exclusive of applicable taxes. You are responsible for any sales tax, VAT, GST/HST, or similar taxes applicable in your jurisdiction. UK For UK customers, prices are exclusive of VAT. The applicable VAT amount will be shown at checkout.

6 Acceptable Use

You agree to use all Fegud services only for lawful purposes. You must not:

  • Use any Fegud service to harass, bully, or harm other users or third parties
  • Post content that is offensive, discriminatory, defamatory, or sexually explicit
  • Impersonate another person or misrepresent your identity
  • Attempt to gain unauthorised access to any account or part of the platform
  • Use automated tools, bots, or scripts to interact with the platform or shop
  • Reverse engineer or decompile any part of the platform
  • Use any Fegud service to distribute malware, spam, or unsolicited communications
  • Violate any applicable law or regulation in Canada, the US, or the UK
  • Transmit worms, viruses, or any code of a destructive nature
HR Administrators must not:
  • Add employees to the platform without their knowledge or consent
  • Use participation data to discipline or penalise employees
  • Share Company or employee data with third parties without employee consent

Participation must be voluntary. Fegud must not be used as a surveillance tool or to monitor employee health in ways that conflict with employment law or human rights obligations in Canada, the US, or the UK.

7 Content

7.1 Your Content

You retain ownership of content you post on the platform. By posting, you grant Fegud a limited licence to display, store, and transmit it solely for the purpose of operating the platform. This licence ends when you delete your content or close your account.

7.2 Content Standards

Your content must not be unlawful, harmful, defamatory, or infringe any third party’s intellectual property rights.

7.3 Fegud Content

All challenge content, imagery, branding, platform design, and website content are owned by or licensed to Fegud. You may not reproduce, copy, or create derivative works from Fegud’s content without prior written permission.

8 Intellectual Property

These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use Fegud’s services for their intended purpose during your subscription term or visit. This licence does not include the right to:

  • Copy, modify, or distribute the platform or any Fegud content
  • Use Fegud to build a competing product or service
  • Remove any Fegud branding from any part of the platform
  • Reproduce or resell any portion of the service without written permission

The Fegud name, logo, “For Teams” wordmark, and all associated brand assets are trademarks of Fegud. They may not be used without prior written permission.

9 Privacy

Your use of all Fegud services is governed by the Fegud Privacy Policy. Please read it. It explains clearly what data we collect, why, and how we protect it.

For Fegud for Teams: HR Administrators act as data controllers for employee data within the platform and are responsible for compliance with applicable privacy laws in their jurisdiction (PIPEDA in Canada, UK GDPR in the United Kingdom, and applicable US state law).

Fegud does not sell personal data. We do not share wellness activity data with insurers, employers for disciplinary purposes, or any third party for advertising. See the Privacy Policy for the full details.

10 Wellness Disclaimer

Not medical advice. The Fegud platform and all challenge activities are for general wellness and self-care purposes only. Nothing on the platform constitutes medical advice, clinical guidance, or professional health recommendations. Always consult a qualified healthcare provider before starting any new physical activity programme.

If you are injured or unwell, do not attempt to complete a physical challenge. Skip the activity and return when you feel ready. Your health always comes first. Fegud accepts no liability for injury or harm arising from attempting any challenge activity.

11 Limitation of Liability

To the maximum extent permitted by applicable law in Canada, the US, and the UK:

  • Fegud provides all services “as is” without warranties of any kind, express or implied
  • Fegud does not warrant that services will be uninterrupted, error-free, or meet your specific expectations
  • Fegud is not responsible if information on the site is not accurate, complete, or current. Material is provided for general information only
  • Fegud is not liable for any indirect, incidental, special, or consequential damages
  • Fegud’s total liability for any claim is limited to the amount paid to Fegud in the 12 months preceding the claim

Nothing in these Terms limits Fegud’s liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law. UK Your statutory rights under UK consumer law are not affected by these Terms.

12 Indemnification

You agree to indemnify and hold harmless Fegud and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Content you post or submit
  • Your violation of any applicable law or third-party rights

13 Termination

13.1 Termination by You

Companies may cancel Fegud for Teams subscriptions as described in Section 5.9. Employees may close their account through app settings at any time. Shop customers may request account deletion by emailing [email protected].

13.2 Termination by Fegud

Fegud may suspend or terminate your access immediately if you:

  • Materially breach these Terms and fail to remedy within 14 days of written notice
  • Pose a risk to other users, staff, or the platform
  • Fail to pay fees when due (for Fegud for Teams subscriptions)
  • If required by applicable law
13.3 Effect of Termination

Upon termination, your access to Fegud services ceases. For Fegud for Teams: Company and employee data is retained for 90 days for export requests, then deleted in accordance with the Privacy Policy. As described in Section 5.6, paid subscriptions are a 12-month commitment and are non-refundable once begun; a Company that cancels retains access through the end of its term. If Fegud terminates an account without cause, Fegud will refund the unused portion of the current term.

14 Governing Law & Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles.

Before any formal proceedings, you agree to contact us at [email protected] and allow 30 days for informal resolution.

UK Nothing in these Terms affects your statutory rights under UK law including the Consumer Rights Act 2015. UK disputes not resolved informally may be referred to alternative dispute resolution before court proceedings are commenced.

US You agree to resolve disputes through binding arbitration in Toronto, Ontario, Canada, except where prohibited by applicable law. Class action waivers apply to the fullest extent permitted by law.

15 General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy, Return & Refund Policy, Shipping Policy, and any Order Form or Subscription Agreement, constitute the entire agreement between the parties and supersede all prior agreements.

15.2 Accuracy of Information

We are not responsible if information on this site is not accurate, complete, or current. The material is provided for general information only and should not be relied upon as the sole basis for making decisions. We reserve the right to modify the contents of this site at any time and have no obligation to update information. It is your responsibility to monitor changes to this page.

15.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

15.4 Waiver

Failure by Fegud to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.5 Assignment

You may not assign or transfer your rights under these Terms without Fegud’s prior written consent. Fegud may assign or transfer these Terms freely, including in connection with a merger, acquisition, or sale of assets.

15.6 Force Majeure

Fegud is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or third-party service failures.

15.7 Language

These Terms are written in English. In the event of any translation, the English version prevails.

15.8 Changes to These Terms

We reserve the right to update or replace any part of these Terms at any time. We will provide at least 14 days’ written notice to HR Administrators before material changes take effect. For website visitors and shop customers, changes are effective immediately upon posting. Your continued use of any Fegud service after changes take effect constitutes acceptance of the revised Terms. UK Where changes affect data processing we will seek fresh consent if required.
